Net Neutrality looks like it took a body blow this AM with the announcement that a court of appeals rules in favor of Comcast and their right to regulate flow of traffic in their own network. Previously the FCC stepped in to say that should not be allowed and that traffic flow in the network should be allowed to flow freely. The court of appeals basically said that the FCC lacked authority.
This moment offers us a crystal clear perspective on how the free market needs to be allowed to step up and provide Choice to consumers of broadband connections. And rather than the FCC fighting for new power, they should simply release bandwidth in the signal spectrum to new distributors of broadband connections. If they do that, this problem together with the free market will likely fix itself and bring incremental innovation along with it. The first reaction will be to create laws and spend time and money in Congress "studying the problem". Let the market handle the issue by freeing up our scarce resource of spectrum needed to make competition possible. Otherwise, we will wait many years for real Choice. The development of the era of Choice depends on this outcome. If Comcast can do what they want to do, well then, they should have competition to correct their perspective back toward what really matters to their market.
